Provider and scope

sidebalance is provided by Tasbasi Gruppe Bülent Tasbasi e.K., Steekberg 5, 24107 Kiel, Germany. Full details are in the legal notice (Impressum).

These terms apply to all contracts about the use of sidebalance, including free offers, between the provider and you as a user.

What sidebalance is

sidebalance is a training and fitness tool for athletes. You upload a photo, the software compares body points in the picture and shows differences between your left and right side. Over several scans you can see how these values change. Training suggestions with videos are included.

sidebalance is not a medical device. It does not diagnose, treat or replace medical, therapeutic or other professional advice. Results are non-binding hints for your training. If you have health questions or complaints, please see a doctor.

Account and access

You create an account to access the member area. You must be of legal age or have the consent of your legal guardians. Your details must be correct.

You confirm your email address and keep your password secret. If you suspect someone else has access, change your password in the settings right away. You can delete your account at any time in the settings.

Plans, prices and term

You can try sidebalance for free or book a plan. The available plans, what they include and what they cost are shown on the price page before you book. The term, the number of scans and the interval between scans depend on the plan you book.

A one-time plan is valid for the period and number of scans stated in the offer. After that, access to this plan ends without you having to cancel. A plan only renews automatically if the offer says so explicitly.

All prices are final prices in euros including statutory VAT where applicable.

Payment

You pay with the payment methods offered at checkout. Payments are handled by our payment providers. The plan is activated once the payment is confirmed. You can find invoices in the member area under “My plans”.

Right of withdrawal for consumers

If you are a consumer, you can withdraw from a contract within 14 days without giving a reason. The period starts when the contract is concluded. To exercise your right, tell us clearly, for example in writing to the address in the legal notice.

If you expressly ask us to start the service before the withdrawal period ends and confirm that you lose your right of withdrawal once the service has been fully provided, the right expires when the service is fully provided. If you withdraw earlier, you pay a reasonable amount for the service provided until then.

Rules of use

Please only upload photos of yourself. Photos of other people may only be uploaded with their consent. For children and teenagers, legal guardians decide.

You may not upload unlawful or offensive content, disrupt the service, bypass protections or share your login details. In case of a serious breach we may block access.

Please train within your abilities. If an exercise hurts, stop. You are responsible for your own training.

Availability

We aim for uninterrupted operation. The service may be temporarily unavailable because of maintenance or reasons beyond our control. There is no entitlement to constant availability.

Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.

In case of slight negligence we are only liable for breach of an essential contractual obligation, meaning one you can regularly rely on, and then only for typical, foreseeable damage.

We give no guarantee for the accuracy of values measured from photos. The photo, clothing, light and posture affect the result.

Data protection

How we handle your data is described in the privacy policy.

Changes to these terms

We may change these terms for a valid reason, such as new features or changed laws. We will tell you in advance by email or in the member area. If you do not object within four weeks, the new terms apply. We will point this out in the notice.

Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies as far as it does not remove the protection of mandatory rules of your country of residence. For merchants, the place of jurisdiction is Kiel.
